Your code has no output. I know this is a piece of code, but... is your $day variable defined or initializated !?

Anyways, i don't know how it will work, but i think if you just use/compare the minutes (in this special case) you can have a better comparison/result.

PHP's date() function returns a string, so try $now == '3' instead.
